Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the FitPockets application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and FitPockets LLC ("FitPockets," "we," "us," or "our").

2. Account Creation

To use certain features of the App, you must create an account. You agree to provide accurate, current, and complete information and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

3. Subscription Plans

FitPockets offers the following subscription tiers:

• Rookie (Free): Manual budgeting, FPI score, dual-income mode
• Semi-Pro ($4.99/month): All Rookie features plus Plaid connectivity, budget reconciliation, and financial statements
• Pro ($14.99/month): All Semi-Pro features plus AI Financial Coach and dashboard customization

All paid subscriptions are processed through Apple's in-app purchase system. Prices are in USD and subject to change with notice.

4. Payment and Billing

All payments are processed by Apple through your Apple ID account. FitPockets does not directly process, store, or have access to your payment information. For billing issues, refunds, or subscription management, you must contact Apple or visit your Apple ID Account Settings.

5. Cancellation

You may cancel your subscription at any time through your Apple ID Account Settings. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until the end of the period for which you have paid.

6. Refund Policy

All refund requests must be directed to Apple, as payments are processed through Apple's in-app purchase system. FitPockets does not process refunds directly. To request a refund, visit reportaproblem.apple.com.

7. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to any part of the App or its infrastructure
• Reverse engineer, decompile, or attempt to extract the source code of the App
• Use the App to harm, threaten, or harass other users
• Interfere with or disrupt the integrity or performance of the App

8. Intellectual Property

The App and all its content, features, and functionality (including but not limited to text, graphics, logos, and software) are owned by FitPockets LLC and are protected by United States and international copyright, trademark, and other intellectual property laws. The FitPockets Index (FPI) scoring methodology is proprietary to FitPockets LLC.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FITPOCKETS LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE APP.

11. Governing Law

These Terms are governed by the laws of the State of California, USA, without regard to conflict of law principles. Any disputes not subject to arbitration shall be brought exclusively in the state or federal courts located in Los Angeles County, California.

12. Dispute Resolution & Arbitration Agreement

Informal Resolution First

Before initiating any formal proceeding, you agree to give FitPockets at least 30 days' written notice of your dispute by emailing support@fitpockets.co with the subject line "Dispute Notice." We will attempt to resolve the dispute informally during that period. If we cannot reach a resolution within 30 days, either party may proceed to arbitration as described below.

Arbitration Agreement

Except for disputes described under "Exceptions" below, you and FitPockets agree that any dispute, claim, or controversy arising out of or relating to these Terms or the App — including questions about the validity, enforceability, or scope of this arbitration agreement — shall be resolved by binding individual arbitration rather than in court.

• Rules. Arbitration shall be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, available at adr.org.
• Location. Arbitration shall be conducted in Los Angeles County, California, or remotely by videoconference or telephone at your election.
• Fees. AAA filing fees are governed by the Consumer Arbitration Rules. FitPockets will pay arbitration fees for claims under $10,000 unless the arbitrator finds your claim frivolous.
• Award. The arbitrator may award any relief that a court could award, limited to your individual claim. The arbitrator's decision is final and binding, and may be entered as a judgment in any court of competent jurisdiction.

Exceptions — Claims Not Subject to Arbitration

Either party may bring claims in small claims court if they qualify. Either party may also seek injunctive or other equitable relief in court to protect intellectual property rights or prevent unauthorized use of the App, without waiving the right to arbitrate other claims.

Class Action Waiver

YOU AND FITPOCKETS EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING. All claims must be brought on an individual basis only.

Opt-Out of Arbitration

You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing support@fitpockets.co with the subject line "Arbitration Opt-Out." Your opt-out notice must include your name and the email address associated with your FitPockets account. If you opt out, all disputes will be resolved in the state or federal courts of Los Angeles County, California, and both parties consent to personal jurisdiction there.

13. Apple EULA

Your use of the App is also subject to Apple's Standard End User License Agreement (EULA).

14. Privacy Policy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
