Acceptable Use

You agree to use FitPockets only for lawful purposes and in accordance with these Terms. You agree not to:

• Attempt to gain unauthorized access to the Service, other accounts, or computer systems connected to the Service
• Interfere with or disrupt the Service or servers or networks connected to the Service

FitPockets may integrate with third-party services, including financial data aggregation services (such as Plaid) and cloud hosting providers. Your use of these third-party services is subject to their respective terms of service and privacy policies. FitPockets is not responsible for the practices or policies of third-party services.

Limitation of Liability

To the maximum extent permitted by applicable law, FitPockets, its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your use or inability to use the Service
• Any errors or omissions in the Service or any information provided
• Any unauthorized access to or use of our servers or your personal information
• Any interruption or cessation of transmission to or from the Service
• Any bugs, viruses, trojan horses, or similar items transmitted through the Service

In no event shall FitPockets' total liability to you exceed the amount you paid to FitPockets in the twelve months preceding the claim, or one hundred dollars ($100), whichever is greater.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. FitPockets does not warrant that the Service will be uninterrupted, secure, or error-free.

Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the United States.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of FitPockets after such changes constitutes acceptance of the updated Terms.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
